1What registration means
Registering lets us consider you for future consultancy projects.
- It does not create a contract of employment, a partnership or an agency.
- It does not guarantee that you will be offered any work.
- There is no fee to register or to remain in the network.
2How projects work
When a project matches your experience, we will contact you to discuss it. No project starts until you and Captivate have signed a written associate agreement for it. That agreement sets out the scope, deliverables, fees, timing and the standard expected, and it takes priority over these terms for that project.
On Captivate projects:
- Captivate contracts with the client, and you work as an independent contractor to Captivate.
- You invoice Captivate through your own company or as a self-employed professional.
- You are responsible for your own tax, social contributions, visas, work permits and professional indemnity insurance.
- Unless your associate agreement says otherwise, fees are paid on agreed terms after the client has paid Captivate for the work concerned.
- Your work is reviewed by Captivate before it is released to the client, and is delivered under the Captivate name.
3Information you give us
You confirm that the information in your registration, CV, project examples and assessment answers is true, accurate and your own work, and that you are entitled to share it.
Please do not name clients or share information you are bound to keep confidential. Describe the property type, location and your role instead. Giving false or misleading information is a reason to remove you from the network.
4The assessment
We may invite shortlisted applicants to a written assessment and a conversation with Michael Butler.
- The questions and any material we share during the process are confidential and must not be copied, published or shared.
- Your answers are used only to assess your fit for the network.
- We do not share individual scores, and we are not obliged to give reasons for our decision.
5Confidentiality
Any information about Captivate, its clients, projects, methods, templates or fees that you receive through the network is confidential. You must not use it for any purpose other than the project or discussion it was shared for, and you must not disclose it to anyone else. This continues after you leave the network.
6Clients introduced by Captivate
If we introduce you to a client, or you meet a client through a Captivate project or proposal, you agree not to offer or provide services to that client directly or through another party, other than through Captivate, for 12 months after the introduction or the end of the project, whichever is later, unless we agree otherwise in writing.
If a client approaches you directly, please refer them to us. The associate agreement for each project sets out this commitment in full.
7Representing Captivate
Being registered does not allow you to act for Captivate, use the Captivate name or logo, or describe yourself as a Captivate consultant, partner or associate, except on a project covered by a signed associate agreement and in the way that agreement allows.
8Our decisions
We may decline any registration, and we may remove anyone from the network at any time, without giving a reason. You may leave the network at any time by contacting us through the contact form.
9Your personal data
- We keep your registration details, CV and assessment answers in private storage, accessible only to Captivate.
- We use them only to consider you for the network and for projects.
- We do not sell them or share them outside Captivate without your permission.
- You can ask us at any time to see, correct or delete your information.
More detail is in our Privacy Policy.
10Liability
To the fullest extent permitted by law, Captivate is not liable for any loss arising from your registration, from not being offered work, or from removal from the network. Liability on a project is governed by the associate agreement for that project.
11Changes to these terms
We may update these terms. The version that applies to you is the one in force when you registered, until you accept a newer version or sign an associate agreement.
12Governing law
These terms are governed by the laws applicable in the United Arab Emirates, and any dispute will be subject to the courts of the United Arab Emirates.
